In the light of the urgent need to take measures to prevent the spread of the Covid-19 and to faithfully comply with the relevant instructions issued by the Medical Services of the Ministry of Health, the Cyprus Supreme Court proceeded with the temporary suspension or trial and or promoting of cases in all Courts.
In light of the above, the Supreme Court of Cyprus ruled as follows:
- From Monday, 4th May 2020, the normal operation of all Registrars will commence. As a result, it will be possible to file both actions and petitions, as well as criminal cases and sworn affidavits in general.
- The Courts of First Instance of each jurisdiction will proceed with the planning of the cases before them, in such a way that their further promotion will be possible, always taking into account the relevant decrees and instructions of the Medical Services of the Ministry of Health, as well as special needs and conditions of each jurisdiction, as one of the existing building facilities, for the purpose of the smooth functioning of the Courts as much as possible and ensuring the health of all parties at trial.
Regarding first appearances and to avoid unwanted overcrowding, relevant instructions will be issued by the competent Courts for their adjournment on a new date and a relevant notice will be given by the competent Registrar to the parties involved. It is understood that where the Court deems it is relevant upon request of the parties concerned that different instructions should be given or that a case should be taken at first instance, it will act accordingly.
- Regrading Supreme Court, the adjudication of the cases before it shall be regulated by the Presidents of their compositions and the interested parties shall be informed accordingly.
As already announced, the court vacations will be limited only for August, in order to carry out the delays caused by coronavirus and the suspension trial of cases.
